1. Acceptance
By accessing cometinnovations.com (the "Site"), you agree to these Terms of Use. If you do not agree, please do not use the Site.
2. Use of the Site
The Site is provided for informational purposes — to describe our services, let you contact us, and host our publications (Field Notes). You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of the Site.
3. Service engagements
Use of the Site does not create a service agreement. When you engage us for installation, retrofit, maintenance, or consultation services, the terms of that engagement are governed by a separate agreement specific to that project, which we'll provide and review with you before any work begins.
4. Intellectual property
The Site, including the "Comet Innovations" name, logo, text, images, code, and design elements, is owned by Comet Innovations or its licensors and is protected by U.S. and international intellectual property laws. You may view and print the Site for personal, non-commercial use; you may not reproduce or republish content without permission.
Field Notes articles may be quoted with attribution; full reposting requires written permission. Images and project examples shown on the Site are attributable to Comet Innovations and may include client work shown with permission.
5. Third-party content and links
The Site may link to third-party websites and embed third-party services (e.g., Acuity Scheduling). We are not responsible for the content, policies, or practices of those third parties.
6. Disclaimer of warranties
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE.
Information on the Site, including in Field Notes articles, is provided for general guidance and does not constitute professional advice for your specific situation. Smart-home installations and electrical work should be performed by licensed professionals.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMET INNOVATIONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SITE. Liability for any service engagement is governed by the separate agreement for that engagement.
8. Indemnification
You agree to indemnify and hold harmless Comet Innovations from any claim, loss, or expense arising out of your violation of these Terms or your misuse of the Site.
9. Termination
We may suspend or terminate your access to the Site at any time, for any reason, without notice. Sections 4, 6, 7, 8, 10, and 11 survive termination.
10. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any dispute arising out of these Terms will be resolved exclusively in the state or federal courts located in California.
11. Changes
We may update these Terms from time to time. The effective date above will reflect the most recent version. Your continued use of the Site after a change constitutes acceptance.
